Garth Duncan

Garth Duncan is a Partner at Webber Wentzel in Johannesburg, specialising in dispute resolution, commercial and criminal litigation, and construction law. He provides end‑to‑end services, from initial advisory and dispute avoidance to full representation in civil and criminal litigation, domestic and international arbitration, forensic and cyber breach investigations, regulatory and administrative reviews, and legal due diligence on large transactions.

He has extensive experience in construction contract advice and disputes, including alternative dispute resolution (ADR), FSCA‑related complaints and prosecutions, and matters involving rental, pension fund, shareholder, trust, and community forum disputes. He is also a Certified Fraud Examiner (CFE) and has represented clients in high‑stakes commercial disputes and regulatory matters.

Garth lectures on Construction Dispute Resolution to Honours and Masters students at the School of Construction Economics and Management, University of the Witwatersrand (2014 to date), and holds a Certificate in Construction Adjudication, a Diploma in Cyber Law, and a Certificate in FIDIC Contracts. He is also a guest lecturer in dispute resolution at the University of Johannesburg and has presented at international conferences and seminars.

He holds an LLB (2012) and a BA (Law) (2009) from the University of Johannesburg. He is an admitted attorney of the High Court of South Africa and has been recognised by Legal 500 (2022–2023) as a legal expert.
