Thomas Karberg

Thomas Karberg is a Senior Associate specialising in administrative and constitutional law, healthcare regulation, public procurement, land reform, restitution, and security of tenure law. He advises large mining companies, property developers, and private landowners on illegal occupations of land in both urban and rural contexts, with deep expertise in the Prevention of Illegal Eviction From and Occupation of Land Act, the Extension of Security of Tenure Act, the Land Reform (Labour Tenants) Act, the Mineral and Petroleum Resources Development Act, and the Expropriation Act.

He has drafted complex opinions, risk assessments, and litigation strategies for mining companies facing unlawful occupation, and has litigated in the Land Court, High Court, Supreme Court of Appeal, and Constitutional Court. He also advises on mining community relations, community trust deeds, surface lease agreements, and community resettlements, ensuring compliance with local and international laws and best‑practice standards. He has represented communities and landowners in reviews of mining rights and has acted for both successful and unsuccessful bidders in public procurement matters.

Thomas holds an LLB from the University of Pretoria (2019) and a BA (Law) (with distinction) from the University of Pretoria (2017). He is an admitted Attorney of the High Court of South Africa.
