Clement Mkiva

Clement Mkiva is a Partner and Co-head of the Litigation Practice Group in the Johannesburg office, practicing in Dispute Resolution. He specialises in all areas of dispute resolution, including local and transnational litigation, arbitration and mediation, with expertise extending to contractual disputes, judicial reviews, shareholder disputes, banking and funding litigation, cross-border securities fraud, insolvency, construction disputes, mining litigation, and defamation claims.

Mr. Mkiva has represented clients across a wide range of industries, including mining houses, banks, telecommunications companies, fund managers, pharmaceutical companies, provident funds, and constitutional and municipal entities. His notable experience includes representing one of the defendants in the largest class action claim in South African history, representing six gold mining companies in the silicosis class action settlement—the largest mediated class action settlement in the southern hemisphere—and representing a global private equity fund in proceedings relating to a performance guarantee for the Twin City Power Project in Ghana.

Clement holds an LLB from Nelson Mandela Metropolitan University and a Master's degree in International Dispute Settlement, a joint LLM program of the University of Geneva and the Graduate Institute of International and Development Studies, where he received specialised training in international commercial and investment arbitration. He is admitted as an attorney of the High Court in South Africa.

He has been ranked by Legal 500 as a Leading Partner for Dispute Resolution in South Africa (2025-2026) and has been recognised by Who's Who Legal as a Litigation Future Leader in the Partners category for several years.
