Bongumusa Sibiya

Bongumusa Sibiya is a Partner in the Johannesburg office, practicing in the firm's Dispute Resolution practice. He specialises in commercial litigation and has amassed experience in a variety of commercial disputes before courts and arbitration institutions, including shareholder disputes, contractual disputes, damages and defamation claims, renewable energy disputes, public procurement matters, and housing and eviction matters.

Mr. Sibiya has acted for the Public Investment Corporation (PIC) and the Government Employees Pension Fund (GEPF) in proceedings for the recovery of millions of Rand in finance loans, successfully opposed a review application for the PIC concerning a construction tender award in the Supreme Court of Appeal (2024 (1) SA 66 (SCA)), and acted for the Central Energy Fund in a matter involving the termination of directors of its subsidiary PetroSA which intersected principles of public law and company law. He has also represented the Independent Electoral Commission (IEC) in matters before the Electoral Court, acted for a Renewable Energy Independent Power Producer in a commercial dispute, and represented clients in matters before the Constitutional Court including Allpay v CEO of SASSA (2014 (1) SA 604 (CC)) and Minister of Home Affairs v Tsebe (2012 (5) SA 467 (CC)).

He holds an LLB from the University of the Witwatersrand and is a member of the Legal Practice Council of South Africa. He previously served as a Law Research Clerk at the Constitutional Court for Justice B Nkabinde, a position that informs his deep understanding of public and constitutional law.
