Rachel Potter

Rachel Potter is a Senior Associate at Bowmans in Johannesburg, specialising in dispute resolution, commercial litigation, and international arbitration. She has extensive experience in court-based litigation (Constitutional Court, Supreme Court of Appeal, High Courts, and the Companies Tribunal), arbitration (both international and domestic), and mediation. Her practice spans contract and company law, administrative and constitutional law, delict, mining law, auditor liability, artificial intelligence and technology, financial regulatory and insurance law, and consumer protection law.

Rachel has represented a large firm of registered auditors in contractual and delictual actions, including a R1 billion contractual claim, as well as administrative, review, and constitutional matters in the High Court, Supreme Court of Appeal, and Constitutional Court. She has also advised on class actions, represented a large mining company in a class action brought by coal mine workers, and advised clients on regulatory investigations by professional bodies including IRBA and SAICA. She has extensive experience in engagements with regulators and enforcement agencies such as the Hawks, the Special Investigating Unit, the Commission of Inquiry into State Capture, and the Independent Regulatory Board for Auditors. She also advises clients on claims and disputes arising from AI decisions and other use of generative AI, including preparing AI risk mitigation and use policies for large corporates.

Rachel holds a BSocSci degree (cum laude) and an LL.B degree (magna cum laude) from the University of Cape Town.
