Kwanda Nyembe

Kwanda Nyembe is an Associate at Bowmans in Johannesburg, specialising in mining law, environmental law, and government procurement law. He advises public and private sector clients on the application of the Mineral and Petroleum Resources Development Act (MPRDA), permitting for prospecting and mining operations, and regulatory compliance.

Kwanda has advised Eskom Holdings SOC Ltd on recovery efforts arising from state capture, including ongoing civil litigation; provided regulatory advice to corporates on compliance with mining, environmental, and employment health and safety laws; advised on the implications of the Expropriation Act 13 of 2024 on mining titles, prospecting rights, water use licences, and environmental authorisations; and advised on the regulatory framework governing Extended Producer Responsibility (EPR). He also advises on environmental permitting requirements for hybrid power generation facilities and is acting in an environmental dispute concerning mine rehabilitation and the granting of a closure certificate, currently before the Supreme Court of Appeal. In procurement law, he advises on government contracting under section 217 of the Constitution and compliance with the PFMA and MFMA, and represents clients in review applications arising from administrative action.

Kwanda holds an LL.B from Stellenbosch University, where he served on the Central Disciplinary Committee and Disciplinary Appeal Committee, as a Justice of the Student Court, and as Vice President of the Golden Key Stellenbosch Chapter. He is an admitted attorney of the High Court of South Africa.
