Hermann Wessels

Hermann Wessels is an Executive at ENS in the Banking and Finance practice, specialising in Banking and Finance Law. He advises on capital markets, structured finance, swaps and derivatives, financial regulation, and alternative investment strategies, and has deep expertise in fund formation and regulatory advisory work for private equity and venture capital funds.

He has acted for banks, a diverse range of corporate and commercial clients, and the public sector in local and international arenas. His experience in capital markets includes debt funding, preference shares, hybrid debt, and asset and cash flow‑based financing transactions. He also has extensive experience in the design and implementation of structured finance transactions, the negotiation and documentation of swaps and derivatives transactions (including under ISDA, GMSLA, and GMRA master agreements), and the establishment of hedge funds. He advises on South African financial regulatory matters, including collective investment schemes, financial advisory and intermediary services, investment management, banking, and company law.

He holds a BA (Honours) (First Class), LL.B, and MA (cum laude) from the University of Cape Town. He is admitted as an attorney of the High Court of South Africa.
