Nicholas Fairbairn

Nicholas Fairbairn is a Senior Associate at ENS in the Tax practice, specialising in Tax Advisory Law. He regularly advises corporates on South African and international tax considerations relating to mergers and acquisitions, corporate reorganisations, funding and deal structuring, employees' tax, employee share incentive schemes, multijurisdictional investment structures and trusts.

Nicholas has experience in corporate restructuring transactions including asset-for-share and unbundling transactions, the taxation of South African and offshore trusts, and tax-exempt status applications under the public benefit organisation regime. He also assists with voluntary disclosure programme applications, advance tax rulings and exchange control applications. In addition, he is experienced in tax litigation and dispute resolution, as well as international tax planning for corporates and high-net-worth individuals. He is a member of a dedicated team specialising in employee and management remuneration, benefits and incentives for blue-chip South African corporates and international firms operating across Africa.

Nicholas holds a BCom and an LL.B. from the University of Stellenbosch, and has completed a Short Course in Legal Writing Hacks for Lawyers from the University of Cape Town. He is a registered tax practitioner and an admitted attorney of the High Court of South Africa. He is a member of the Legal Practice Council.
