Juanita Broom

Juanita Broom is an Executive at ENS in the Mine and Occupational Health and Safety practice. Her practice focuses on Mining Law.

Juanita has represented and appeared on behalf of clients in the mining, engineering, construction, cement and manufacturing industries on a variety of matters. Her skill set and service offering encompasses all facets of mine and occupational health and safety law.

She has represented listed gold and platinum mining companies (and their senior management and executives) at Formal Fatal Inquiry Proceedings and investigations conducted in terms of the Mine Health and Safety Act, No. 29 of 1996 (MHSA). She has also represented companies (and their senior management and executives) at investigations conducted in terms of the Occupational Health and Safety Act, No. 85 of 1993 (OHASA), provided legal advice and furnished legal opinions to clients on various legislative requirements in terms of the MHSA and OHASA, and drafted representations to the Principal Inspector of Mines and the Chief Inspector of Mines following instructions issued in terms of sections 54 and 55 of the MHSA.

She regularly conducts due diligence investigations and drafts statutory letters of appointment in respect of both the MHSA and OHASA.

Juanita has also assisted a gold mining company in defending various civil litigation instituted against them, in particular 1,256 individual claims instituted for allegedly causing silicosis, and has also assisted in defending the silicosis class action certification application, which consisted of approximately 250,000 potential claimants.

She holds an LLB from the University of Pretoria and is admitted as an attorney of the High Court of South Africa.
